Zamboanga Officials Dictate WMSU

1. According to Political Science instructor, Prof. Mahmor Eding that Zamboanga City officials disappointed with the newly elected WMSU president. Their candidate was defeated in the election. If this is true, imagine that the academic institution controlled by politicians. 

CSC dared to bring Dr. Umar's appointment issue to SC

The Office of the President of Western Mindanao State University through its special assistant and spokesperson on Friday dared Civil Service Commission Commissioner Mary Ann Fernandez Mendoza to take herissue against Dr. Luningning Umar to the Supreme Court if they want to challenge the legality of her appointment as WMSU president

“CSC’s ruling to my mind I am talking as Mahmor Edding is just a mere scrap of paper. Scrap of paper because under the law CSC has only the power to evaluate appointments. Now, as far as the WMSU presidency is concerned, the appointment was already given and confirmed by theBoard of Regents which is allowed by law under Republic Act 8292,” Prof. Mahmor Edding said in an interview.

Last December 22, 2011, CSC Commissioner Mendoza wrote CHED Commissioner and WMSU-BOR Chairperson Nona S. Ricafort to invalidate the appointment issued to Dr. Umar on November 15, 2011 as WMSU president on the ground that it is violative of CSC’s Rules and Regulations under the Revised Omnibus Rules on Appointments and Other Personnel Actions.

The Commissioner stressed that it is imperative for the WMSU-BOR to give effect and implement the invalidation of Dr. Umar’s appointment and that any contrary action would amount to neglect of duty or conduct prejudicial to the best interest of the service, as the case maybe, and is a ground to be held liable for indirect contempt of the Commission.

Edding questioned why the CSC did not rule on those employees of the CHED in Luzon who sought the WMSU presidency and state university presidency. “Ibig sabihin nagtatrabaho sila sa CHED tumakbo sila presidente then naging presidenteand then may natalo pero hindi sila kinu-question ng CSC. Now, dito sa Zamboanga just because Dr. Umar was elected kinu-question na. Bakit ba? Dahil mayron mga tao hindi marunong tumanggap ng kanilang pagkatalo. So that is the main issuehere.”

He said assuming for the sake of argument that there is a legal problem as the CSC may say or admit, then the solution is judicial review of the appointment but not for the CSC to say that it is invalid.

“Why this problem happening? To summarize, there is only one problem here there is only one issue that there are two Zamboanga City leaders by which they have their respective candidate who was defeated, natalo sa election. Sino ang kandidato nila? To be honest, Dr. Milabel Ho, I am referring to the Honorable Regent, Mayor Celso Lobreat, sinuportahan niya si Dr. Ho together with another political leader in Zamboanga City, Honorable Congresswoman Beng Climaco who also supported Dr. Ho. So natalo ito. Ho got only three votes, Dr. Umar got six, so iyan ang dahilan until now there is this problem and using CSC as a legal mechanism as if may hadlang,” Edding said.

The professor appealed to Lobregat and Climaco to already acknowledge and officially support the leadership of Dr. Umar as WMSU president. “I am talking as Mahmor Edding, I consider it (CSC ruling) as a mere scrap of paper. Why? Because the Court has the final say on certain appointment, particularly if it is legal, constitutional valid or not valid, only the court can say so.”

According to Edding, if the Supreme Court says it is invalid and is illegal then let they will all support and adhere to the judicial decision of the Court, “but if the CSC open ruling that it is invalid then again to conclude the CSC has no power to invalidate any appointment issued already by duly competent authority such as the WMSU Board of Regents.”

Edding also challenged the CSC to put him in contempt, saying that the issue is purely legal because the Supreme Court has the final say to interpret with finality any question involving legal question.

“CSC is trying to imply that if we will not follow their ruling we will be put in contempt. Well, how can we follow if it is just a mere expression of opinion by one Commissioner?”

He further said that if anyone believed that the Board, particularly the six members, have made incorrectly the proper solution is for them to go Court, not capitalizing on CSC ruling.

Reiterating that the CSC ruling is just a mere expression of opnion, by which to him, is just a mere scrap of paper because it has no power to declare any appointment to be illegal or legal, it is only the law and the Supreme Court.

“So any aggrieved party should go to court question the appointment and then we will appeal until it will reach to the Supreme Court. If the Court says the appointment is illegal, we will vow to it,” he said.

Meanwhile, former member of WMSU Board of Regents Prof. Jerry Hamja said in the wake of the issue over the WMSU presidency it will greatly affect the university because the president can not focus the necessary reform and other program of activities in the institution.

“The university has been suffering from operational shortcomings since the previous years and the president her job is repairing the damages, putting all things in place again and moving forward but with this problem it looks like will really affect the job of the president related to the administration of the university,” Hamja added.

As of press time, Board’s Legal Officer Atty. Marcos said the order of Civil Service Commission invalidating theappointment of Dr. Umar has not yet attained with finality.

“So the invidual members of the Board or the Board as collegial body may resort to legal remedies and strategies under the rules. This issue should be brought to proper forum, but in the meantime Dr. Umar will continue to provide the quality services required by the civil service,” Marcos said.

He advised the people who may ride on the issue to wait for the legal processes to take place.
